1 General information about the sweepstakes:

The sweepstakes is a promotion of 25hours Hotel The Royal Bavarian (organizer).

Participation in the sweepstakes of 25hours Hotel The Royal Bavarian is possible exclusively under the conditions of participation listed here and in compliance with the privacy policy described below. By participating in the sweepstake, the participant expressly accepts these conditions of participation and the data protection conditions. The sweepstakes is in no way sponsored, endorsed or organized by Meta Platforms Technologies Ireland Limited. 25hours Hotel The Royal Bavarian reserves the right to cancel or terminate the Sweepstakes at any time for cause.

2 Eligibility, participation requirements, campaign period:

Any person who leaves a comment for the sweepstake of the organizer by 12pm CET on 01.12.2024 is eligible to participate.

Participants before the age of 17 need the consent of their legal representatives.

Participation is required to comment on the giveaway post on Instagram by @25hourshotel_munich and @lebenliebeschnaps from 27.11.2024 and to follow both @25hourshotel_munich and @lebenliebeschnaps at the time of the drawing.

Each participant may only win once.

The legal process is excluded. Employees of 25hours Hotel The Royal Bavarian are excluded from participation.

3 Other:

Participants who violate these conditions of participation or attempt to manipulate the vote can be excluded from participation in the competition, even retrospectively. If the conditions for exclusion are met, prizes may be subsequently withdrawn or prizes already delivered may be reclaimed. In this case, the organizer will determine a new winner.

4 Possible winnings:

The following possible prizes can be obtained by the participant:

• 4 books “New love, same shit?!” by Yvi Blum. The books will be shipped only within the DACH region.

The legal process is excluded.

The lot decides which participant receives a prize. The winners will be notified by direct message on Instagram by 05.12.24 at the latest. The legal process is also excluded here. A change or cash payment of the prize is excluded.

After notification through @25hourshotel_munich, the winner must report within 7 calendar days from notification the contact information (last name, first name, e-mail address) via a private message to the Instagram channel @25hourshotel_munich. If a winner does not report within this period or if he is excluded (cf. Clause 2, 3, 4), his prize will be forfeited without replacement and a new draw will be held to award this prize.

The participant is responsible for the accuracy of the data provided. 

5 Liability:

Claims for damages against the organizer in connection with the sweepstakes are excluded – within the legally permissible scope – regardless of the legal grounds, unless the organizer or his representative/legal agent would have intentionally or grossly negligently violated legal obligations or it is the liability for damages arising from injury to life, limb or health, which are based on a negligent breach of duty by the organizer or an intentional or negligent breach of duty of a legal representative or vicarious agent of the organizer.

In addition, liability is not excluded for the violation of essential contractual obligations, the fulfillment of which enables the proper implementation of the competition, the violation of which endangers the achievement of the purpose of the contract and on the compliance of which the participant regularly relies.

6 Data protection:

The organizer as the responsible body shall ensure the highest possible standard of data protection in the context of the sweepstakes on the basis of the European Data Protection Regulation or the Federal Data Protection Act and shall comply with the relevant legal provisions in this regard. The personal data will only be used to carry out the sweepstakes and within the framework of the sweepstakes (Art. 6 I b DSGVO). The winner’s personal data will only be published within the scope of the present consent and otherwise used to send the prize (principle of data economy). The provision of this data is mandatory, without providing this data, participation in the competition is not possible. No data will be passed on to third parties. Participants are entitled to statutory rights of information, amendment, deletion, objection and complaint to the competent supervisory authority, as well as a right to restriction of processing and data transfer. Participants only have the right to object insofar as the processing of their personal data is based on the overriding legitimate interest of the organizer (Art. 6 I f DSGVO). Insofar as the processing is based on the consent of a participant, there is a right of revocation vis-à-vis the organizer, who will inform the submitting entity of this without delay, insofar as no personal participation of the person concerned is given. The stored personal data of the winners will be deleted after the termination of the sweepstakes.

8 Jurisdiction/Applicable Law:

In case of disputes, German law shall apply exclusively. As far as legally permissible, the registered office of the organizer is agreed as the place of jurisdiction. Insofar as the participant does not have a general place of jurisdiction in Germany, or moves his/her residence abroad after participation, the organizer’s registered office is also agreed as the place of jurisdiction.

9 Severability clause:

Should individual provisions of these conditions of participation be invalid or a loophole exists, this shall not affect the validity of the remaining provisions. The ineffective or missing provisions shall be replaced by a provision that comes closest to the purpose of the contract and the statutory provisions.
